To all PCA Stewards: Union accepts Employer’s Interpretation of New Language on Overtime for Part-Timers
The Union now has the Employer’s interpretation of the provincially imposed language replacing designated days off for part-timers. The Union accepts this interpretation as the logical interpretation of the new language. All stewards who have attended contract interpretation sessions please note. For ease we are calling it the "rolling 3" in reference to the three consecutive bi-weekly pay periods.
The Rolling 3 - How it Works:
In the calculation of overtime for hours worked over 216 straight time hours in three consecutive bi-weekly pay periods, several large health regions are using the "rolling 3". In other words:
- Count One: The Employer first calculates the straight time hours in weeks 1 through 6 (first three bi-weekly pay periods), in the example provided the part-timer has worked 229 hours in weeks 1through 6 and is therefore paid 13 hours overtime.
- Count Two: The Employer drops off the first two week pay period in count one and starts the next calculation over again in week 3. The straight time hours in weeks 3 through 8 are counted. In the example provided the part-timer has worked 222 hours and is paid 6 hours overtime.
- Count Three: The next calculation would start in week 5, as the part-timer counts the straight-time hours in weeks 5 through 10. The same process continues throughout the year as the part-timer picks up additional hours.
- The Employer only excludes the overtime hours paid pursuant to the provisions in Article 27.05 (B) (3). Those hours are identified in the example in bold and underlined.
- All straight-time hours in the rolling three are counted each time whether or not they have contributed to an overtime payout under Article 27.05 (B) (3) (b) in a previous six week period.
