SARS: What to do if you are exposed to SARS and / or are unable to work because of a SARS outbreak
You should not be required to use your sick bank for a SARS-related leave from the workplace. This is a WCB Claim or employer paid leave

There are many reasons why you may be unable to work due to SARS. These may include:
  • you have been diagnosed with SARS or are suspected to have SARS and are under observation
  • you have come into contact with someone with SARS at work
  • you have been sent home because your unit and/or facility has been closed due to SARS
  • you have come into contact with someone who has or may have SARS
If you have been exposed to SARS at work and/or lose time as a result of a work related SARS outbreak, you should file a claim with the Workers Compensation Board (WCB). Your Employer cannot refuse to submit a WCB claim on your behalf, even if you have not lost time due to SARS or if you are only a "suspect" case of SARS due to exposure.

You are entitled to be paid by your employer if you have been instructed not to come to work

If you have missed work due to SARS the Employer should continue your wages as if you are working for the duration of the time that you are required to be away from work. This includes all shift differentials, premiums, responsibility pay and overtime.

If you are a Regular Full Time or Part Time nurse you would continue to be paid as if you are working, including the average of the previous 26 weeks of work (for the purposes of overtime and additional shifts picked up);

If you are a Casual nurse you would be paid a minimum of your weekly earnings as averaged over the past 26 weeks. In addition, you will be paid for any pre-booked shifts over and above the weekly average which you miss due to SARS.

What Should I Do If My WCB Claim is Refused or the Employer Does Not Pay Me Appropriately?
Contact your BCNU steward at your workplace immediately.
