Nurses displaced following Bill 29 red-circled when bumping or choosing vacancy
HEABC agrees to settle dispute based on other unions’ wins at arbitration

In 2002, following the imposition of Bill 29, the Health Employers Association of BC (HEABC) stated that red-circling of displaced employees was only applicable when an individual chose a vacancy in a lower rated position. It would not apply if someone bumped into a lower rated position. (Red-circling refers to the practice of maintaining an employee’s current rate of pay if they have no choice but to go into a lower rated position.)

On June 7, 2002 BCNU filed an Industry Wide Application Dispute (IWAD) taking the position that red-circling following displacement should apply for both bumping or choosing vacancies.

The Health Sciences Association (HSA) and the BC Government and Service Employees Union (BCGEU) also filed industry grievances on this issue. The BCNU IWAD was put on hold until the HSA and BCGEU grievances were resolved.

Both of these grievances were resolved at arbitration in favour of the unions. Therefore, BCNU proposed to HEABC that the issue be settled without proceeding to another arbitration and that red-circling would apply to displaced nurses both when bumping and when selecting a vacancy. HEABC agreed.

Back-pay due
Anyone who was displaced following Bill 29 and who bumped into a lower rated position without being red-circled should now be eligible to receive back-pay. Please contact a BCNU steward for assistance.
